Hereinafter referred to as “TrustFair.de”, “we”, “us” or “platform operator”.
2. Scope of the revocation policy
This cancellation policy applies to consumers within the meaning of § 13 BGB who book paid services, premium functions, digital additional functions or other paid services via TrustFair.de.
The consumer is any natural person who enters into a transaction for purposes which are predominantly not attributable to his trade or self-employed professional activity.
This cancellation policy does not apply to entrepreneurs within the meaning of § 14 BGB if the contract is concluded in the exercise of a commercial or independent professional activity.
Entrepreneurs, traders, self-employed, freelancers, companies, dealers, service providers or other business providers generally have no legal consumer right of withdrawal when booking services for their company or their professional activity.
3. Right of withdrawal for consumers
Consumers have the right to withdraw from this contract within 14 days without giving reasons.
The withdrawal period is fourteen days from the date of conclusion of the contract.
In order to exercise the right of withdrawal, consumers must inform us by means of a clear statement of their decision to revoke this contract.
The revocation can be declared, for example, by letter, fax or e-mail.

Consumers may use the attached model withdrawal form. However, the use of this form is not mandatory.
In order to safeguard the withdrawal period, it is sufficient that the notification about the exercise of the right of withdrawal is sent before the expiry of the withdrawal period.
4. Consequences of withdrawal
If Consumers revoke this Agreement, we shall refund all payments received from the Consumer without undue delay and at the latest within fourteen days from the date on which we received notification of the revocation of this Agreement.
For this refund, we use the same means of payment that the consumer used in the original transaction, unless expressly agreed otherwise.
The consumer does not incur any charges because of this repayment.
5. Cancellation for already started service
If the consumer has requested that the service begin during the withdrawal period, the consumer has to pay us a reasonable amount.
This amount corresponds to the proportion of the services already provided up to the time when the consumer informs us of the exercise of the right of withdrawal with regard to this contract.
The amount is calculated in relation to the total amount of the services provided for in the contract.
This applies in particular to cases in which a paid account, a premium package, an additional function, a widget, a seal, an analysis function, an export, a team access or another digital platform function has already been activated or used at the express request of the consumer before the expiry of the withdrawal period.
6. Expiration of the right of withdrawal for fully provided services
The right of withdrawal may lapse early in a contract for services if:
a) the consumer has expressly agreed that TrustFair.de begins the execution of the service before the expiry of the withdrawal period,
b) the consumer has confirmed that he loses his right of withdrawal if the contract is fully fulfilled by TrustFair.de, and
c TrustFair.de has provided the service in full.
Merely unlocking a current subscription or a time-limited premium package does not automatically mean that the service has been fully provided.
In the case of ongoing services, subscriptions or continuous premium functions, the statutory assessment of the individual case remains.
7. Digital content and digital functions
Insofar as TrustFair.de provides digital content that is not delivered on a physical data carrier, the right of withdrawal may lapse prematurely under the legal conditions.
This may apply in particular if:
a) the consumer has expressly agreed that TrustFair.de begins the execution of the contract before the expiry of the cancellation period,
b the consumer has confirmed that by his consent he loses his right of withdrawal from the beginning of the execution of the contract, and
c TrustFair.de has provided the consumer with a corresponding confirmation.
Digital content or digital functions can in particular be:
a) download files,
b) digital seals,
c) widget code,
d) digital evaluations,
e) exports,
f) digital reports,
g) other non-physical digital content.
8. Immediate activation notice
If the consumer wants paid functions to be unlocked immediately, TrustFair.de can request explicit consent in the ordering process.
Such consent may, for example, read as follows:
I expressly request that TrustFair.de begins with the execution of the service before the expiry of the withdrawal period. I am aware that I will lose my right of withdrawal if the contract is fully fulfilled by TrustFair.de. In the event of revocation before full performance of the contract, I have to pay a reasonable amount for services already provided.
For example, for digital content that is not delivered on a physical medium, the consent may be as follows:
I expressly agree that TrustFair.de begins the execution of the digital content contract before the expiry of the cancellation period. I am aware that by my consent I may lose my right of withdrawal from the beginning of the execution of the contract.
These information should be actively confirmed in the ordering process, for example via an unpreselected checkbox.
9. No right of withdrawal for entrepreneurs
There is no legal right of withdrawal for entrepreneurs if they book paid services for their commercial, self-employed or professional activity.
This applies in particular to:
a) enterprises;
b) traders,
c) dealer,
d) service providers,
e) self-employed,
f) freelancers,
g) clubs, insofar as they act entrepreneurially,
h) other business providers.
If a company bookes a premium package, a company profile, additional functions, evaluation management, widgets, seals, analysis functions or other services for business purposes, there is generally no consumer right of withdrawal.
The termination rights from the contract, the GTC, the terms of use or the booked package remain unaffected.
10. No revocation for free services
For purely free services there is in principle no payment back processing entitlement.
Free user accounts, free company profiles or free basic functions can be terminated, deleted or restricted according to the terms of use.
A statutory consumer right of withdrawal is practically only relevant for paid contracts.
11. Relationship to termination and term of contract
The revocation must be distinguished from a termination.
A revocation concerns the reversal of a contract within the statutory revocation period.
A termination concerns the termination of an ongoing contract for the future.
In the case of paid packages, subscriptions or premium functions, the respective agreed terms, extensions and notice periods apply after the expiry of the cancellation period.
These result from the booked package, the service description, the GTC, the terms of use or the respective order overview.

If you wish to revoke the contract, you can fill out this form and return it to us. The use of this form is not mandatory.

13. Revocation by e-mail
A revocation can also be declared informally by e-mail.
One possible formulation is:
“I hereby revoke the contract concluded by me for the paid service on TrustFair.de.”
The e-mail should, as far as possible, contain the following information:
a) name,
b) e-mail address of the account,
c) booked service,
d) order date,
e) Customer number or invoice number, if available.

14. Reimbursement
After receipt of an effective revocation, we check the process and refund received payments in accordance with the legal regulations.
If services have already been provided at the express request of the consumer within the withdrawal period, a reasonable amount for the services already provided can be withheld or charged.
The repayment shall in principle be made by the same means of payment used in the original payment, unless otherwise agreed.
15. Misuse and misrepresentation
The right of withdrawal may not be exercised improperly.
Incorrect information about the consumer status, identity, contractual relationship or booking purpose can lead to the rejection of unjustified claims.
If a user has explicitly booked a service as an entrepreneur or for business purposes, he cannot invoke a consumer right of withdrawal without further ado.
